Welcome to Arctic Vault! By accessing and using our website (www.arcticvault.com.au) and purchasing products from us, you agree to be bound by the following Terms and Conditions. Please read them carefully.

1. General Information

  • Arctic Vault (hereinafter "we," "us," or "our") is an online retailer specialising in Pokémon trading cards, Funko Pop! figures, and graded collectibles.

  • These Terms and Conditions govern your use of our website and your purchases from us.

  • We reserve the right to modify these Terms and Conditions at any time without prior notice. Any changes will be effective immediately upon posting on our website.  

  • Your continued use of our website after any changes constitutes your acceptance of the new Terms and Conditions.  

2. Product Information

  • We make every effort to ensure that product descriptions and images are accurate. However, we do not warrant that product descriptions or other content are error-free.  

  • Product availability is subject to change without notice.

  • Graded cards are sold as-is. Grading is performed by third-party companies, and we do not guarantee the accuracy or consistency of their grading.

  • Funko Pop! boxes may have minor imperfections, such as dents or scratches. We do not guarantee mint condition for non-graded items.

  • Pokemon cards, due to the nature of packaging, may contain duplicates, and cards are random. We are not responsible for the contents of sealed products, bulk card purchases or condition they arrive in.

3. Ordering and Payment

  • By placing an order, you are making an offer to purchase the products in your order.

  • We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product descriptions, or suspected fraudulent activity.  

  • Payment must be made through the payment methods offered on our website.

  • Prices are in AUD and are subject to change without notice.

  • Applicable sales tax and shipping fees will be added to your order total.

4. Shipping and Delivery

  • We will make every effort to ship your order within the estimated delivery timeframe. However, we are not responsible for delays caused by shipping carriers.  

  • Risk of loss and title for items purchased from us pass to you upon delivery of the items to the carrier.

  • Shipping costs and delivery times vary depending on the destination and shipping method selected.

  • We are not responsible for any customs duties or import taxes that may be incurred.  

  • We only ship to addresses within [specify regions].

5. Returns and Refunds

  • We do not accept returns and/or refunds for change of mind.

  • Graded cards are non-returnable unless they are significantly not as described.

  • Ungraded or raw pokemon trading cards are non-refundable. 

  • To initiate a return for an item that is significantly not as described, please contact our customer service team at arcticvault@protonmail.com for instructions.

  • Refunds will be issued to the original payment method after we receive and inspect the returned items.

  • Shipping costs are non-refundable unless the return is due to our error.  

  • We may charge a restocking fee for some returns.

6. Limitation of Liability

  • To the fullest extent permitted by law, Arctic Vault shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our website or your purchase of our products.  

  • Our total liability for any claim arising from your use of our website or your purchase of our products shall not exceed the total amount paid by you for the products in question.

  • We are not responsible for any loss or damage of items that occur during shipping once it has left our hands.

7. Intellectual Property

  • All content on our website, including but not limited to images, text, and logos, is the property of Arctic Vault and is protected by copyright and other intellectual property laws.

  • You may not use any content from our website without our express written permission.  

8. Governing Law

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Victoria.  

  • Any disputes arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Victoria or the Commonwealth of Australia.

  • Promotions are subject to change or be discontinued without notice.
